2009 – 2018

  • 2009 – Capture of Thomas Kwoyelo
  • July 2011 – Beginning of the proceedings at the ICD
  • 22.09.11 – The Constitutional Court held that Kwoyelo has acquired the legal right to amnesty and that his right to equal treatment has been violated. The Court directed the ICD to cease Kwoyelo’s trial and asked to process his amnesty certificate.
  • April 2015 – Appeal against the decision granting amnesty by the Attorney General. The Supreme Court ruled that the trial of Kwoyelo by the ICD was proper and that it should proceed.
  • 21.09.16 – Dismissal of challenges to the jurisdiction of the ICD
  • 23.09.16 – Victims’ right to participate granted by the ICD
  • 01.02.17 – The ICD dismissed the Prosecution’s irregular application for redacted disclosure and gives fresh guidelines to the Prosecution to make a new application.
  • 23.02.17 – The Court allowed the Prosecution to amend the first indictment. The Defence raised an objection to the indictment, arguing that customary international law was inapplicable in the Uganda legal regime and that it breached the principle of legality.
  • 22.11.17 – The ICD dismissed the Defence’s objections and held that the Constitution of Uganda did not prohibit the application of customary international law.
  • 30.08.18 – The ICD examined the summary of the case, the witness statements provided and other documentary evidence provided by the prosecution, and confirmed all the 93 charges against Thomas Kwoyelo.
