Le droit tchadien ne contient aucune disposition faisant expressément référence à une « arrestation administrative ». En revanche, il comprend des dispositions relatives aux rétentions de sûreté qui autorisent l’autorité compétente à priver une personne de sa liberté pour une brève durée déterminée par la loi.
Is there a form of administrative arrest?
The Ugandan law establishes an arrest as preventive action to prevent an offence before it is committed. It is also called “prevention of offences”.
The point is to prevent someone to cause an offence, or to commit a breach of the peace or to disturb the public tranquillity, or to do any wrongful act that may probably occasion a breach of the peace or disturb the public tranquillity.

Is there a form of administrative arrest?
L’arrestation administrative est opérée en prévention d’une infraction, et non en réaction à sa commission. Le décret du 16 mai 1960 relatif à l’atteinte à l’ordre et à la tranquillité publique consacre les principes relatifs à l’arrestation administrative.
La Police nationale congolaise exerce les fonctions de la Police judiciaire et celles de la Police administrative. Cette dernière est chargée du maintien de l’ordre public en assurant la sécurité, la tranquillité et la salubrité.

Is there a form of administrative arrest?
Il existe en pratique deux types d’arrestations en Tunisie: l’arrestation administrative et l’arrestation judiciaire, mais le Code de procédure pénale ne différencie pas les deux arrestations.
Au contraire de l’arrestation judiciaire qui suit la commission d’une infraction, l’arrestation administrative est une action préventive destinée à empêcher l’exécution d’une infraction. L’arrestation administrative s’opère donc sans que l’individu arrêté n’ait commis d’infraction.
